Though nominated for chief justice of the U.S. Supreme Court in 1873, an irregularity regarding election fraud kept this Territory of Oregon chief justice, Grant's attorney general (1871-75) and Oregon senator (1865-71) from taking that office; ironically, it was he and Lew Wallace who in 1876 examined the controversial Florida presidential vote, siding with Hayes.
